By accessing or using EnterT3ch ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.

2. Description of Service

EnterT3ch is a digital platform that connects athletes, content creators, and brands for collaboration opportunities. We provide tools for profile creation, deal discovery, application management, and performance tracking.

3. User Accounts

Registration

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must be at least 13 years old to use the Platform
• One account per person is permitted

Account Responsibilities

• Keep your login credentials confidential
• Notify us immediately of any unauthorized access
• Update your information to maintain accuracy

4. User Conduct

You agree not to:

• Provide false or misleading information
• Impersonate another person or entity
• Engage in spam, harassment, or abusive behavior
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems
• Use the Platform for illegal or fraudulent activities
• Upload malicious software or harmful content

5. Content and Intellectual Property

Your Content

• You retain ownership of content you upload
• You grant us a license to use your content on the Platform
• You are responsible for ensuring you have rights to uploaded content
• You warrant that your content doesn't infringe on others' rights

Platform Content

• EnterT3ch owns all Platform-related intellectual property
• You may not copy, modify, or distribute our content without permission
• Trademarks and logos are property of their respective owners

6. Deals and Collaborations

Platform Role

• We facilitate connections between users. For deals funded through the Platform's escrow flow, EnterT3ch holds brand-funded payments and releases them to the creator or athlete upon deliverable approval, as described in Section 7
• Users are responsible for their own contractual relationships and deal terms
• We do not guarantee the success of any collaboration

User Responsibilities

• Fulfill your obligations in accepted deals
• Communicate professionally with other users
• Report any disputes or issues promptly
• Comply with FTC guidelines for sponsored content

7. Payment and Fees

• Subscription fees are non-refundable unless otherwise stated
• We may change pricing with 30 days notice
• Payment disputes should be reported within 30 days
• For deals funded through the Platform's escrow flow, EnterT3ch (via its payment processor, Stripe Connect) holds brand-funded payments in escrow and releases them to the creator or athlete only after the agreed deliverables are approved. EnterT3ch is responsible for holding and releasing escrowed funds as described here; it is not responsible for the underlying collaboration outcome, content quality, or obligations outside the escrow flow
• Funds held in escrow may be refunded to the brand or released per the Platform's escrow rules. EnterT3ch is not liable for amounts not funded through escrow or for payments arranged directly between users outside the escrow flow

8. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Termination

By You

• You may terminate your account at any time
• Termination does not relieve you of existing obligations

By Us

• We may suspend or terminate accounts for violations
• We may discontinue the Platform with reasonable notice
• Serious violations may result in immediate termination

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL ENTERT3CH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

12. Indemnification

You agree to indemnify and hold EnterT3ch harmless from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use constitutes acceptance of new Terms.
